1. Acceptance of Terms

By using our website, submitting a form, booking a lesson, or engaging a tutor through Melbourne Tutoring Services (we, us, our), you agree to these Terms of Service.

2. Service Scope

We provide tutor matching, session coordination, and educational support services. Tutors may be employees or independent contractors. We do not operate as a school, childcare provider, or medical/psychological service.

3. No Academic Outcome Guarantee

We do not guarantee specific grades, ATAR scores, scholarship outcomes, admission results, or exam outcomes. Student progress depends on attendance, effort, prior ability, and external factors beyond our control.

4. Parent and Guardian Responsibilities

• Provide accurate student and contact information.
• Supervise minors as appropriate for age and circumstance.
• Ensure a safe and suitable tutoring environment for in-person sessions.
• Promptly notify us of safety concerns, incidents, or conduct issues.

5. In-Person Session Safety and Verification

For in-person tutoring, parents/guardians and students are solely responsible for choosing and approving session location, supervision arrangements, access control, and personal safety measures.

• Parents/guardians must independently verify tutor identity and required documents before sessions.
• Where legally required, parents/guardians must verify current Working With Children Check details.
• Parents/guardians must determine whether the location is appropriate and safe.

To the maximum extent permitted by law, we are not liable for incidents arising from location choice, transport arrangements, third-party premises, or supervision decisions made by parents/guardians.

6. Tutor Status and Screening

We apply screening and onboarding processes; however, parents/guardians remain responsible for their own due diligence and safety decisions for in-person engagements.

7. Bookings, Fees, and Payment

• Fees are quoted in AUD and may vary by subject, level, and format.
• Payment timing and method are advised at booking or invoicing.
• Overdue amounts may result in paused services or cancellation.

8. Cancellations and Rescheduling

• Sessions cancelled with at least 24 hours notice are generally not charged.
• Late cancellations or no-shows may incur partial or full session fees.
• Repeated short-notice changes may affect tutor availability.

9. Refunds and Guarantee

Any stated guarantee applies only as expressly published by us and may include conditions. Approved refunds are processed to the original payment method where practical.

10. Website and Platform Use

You agree not to misuse the website, including by:

• Uploading unlawful, abusive, or harmful content.
• Attempting unauthorised access, scraping, or system disruption.
• Submitting fraudulent information or impersonating another person.

11. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim connected to services or website use is limited to the amount paid by you for the relevant service in the preceding three months, or the minimum amount required by law, whichever is greater.

We are not liable for indirect, incidental, special, punitive, or consequential loss, including lost opportunities, data, goodwill, or academic outcomes.

12. Indemnity

You agree to indemnify and hold us harmless from claims, losses, liabilities, and costs arising from your misuse of services, breach of these Terms, inaccurate information, or unsafe in-person arrangements selected by you.

13. Privacy

Your use of our services is also governed by our Privacy Policy.

14. Termination

We may suspend or terminate services where there is non-payment, safety risk, abusive conduct, policy breach, or other reasonable business grounds.

15. Governing Law

These Terms are governed by the laws of Victoria, Australia. Courts of Victoria have non-exclusive jurisdiction, subject to any mandatory consumer protection rights.

16. Updates to Terms

We may update these Terms from time to time. Continued use after updates constitutes acceptance of the revised Terms.
